These Terms of Service constitute a legally binding agreement between you and Habilis Domains. By using our services, you agree to comply with and be bound by these terms.
By accessing and using Habilis Domains services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Habilis Domains provides: (1) Domain management and DNS hosting services for your existing domains, (2) AI-powered fraud detection API for transaction analysis and risk scoring. We do not register domains directly but provide management tools and fraud prevention services. You retain ownership of your domains registered with your chosen registrar.
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
You agree to use our services in compliance with all applicable laws. Prohibited activities include: illegal activities, spam, phishing, malware distribution, DDoS attacks, unauthorized access attempts, or any activities that harm our platform or other users. We reserve the right to suspend accounts that violate this policy.
Subscription fees are billed monthly or annually in advance. All fees are non-refundable except as required by law or during the beta period. Prices are subject to change with 30 days notice. Failure to pay fees may result in suspension of services. You can cancel your subscription at any time; access continues until the end of your billing period.
Our fraud detection API analyzes transaction data you submit to assess fraud risk. You are responsible for: (1) Obtaining necessary consents to process user data, (2) Complying with applicable privacy laws, (3) Using risk scores appropriately in your decision-making. We provide risk assessments but do not make final transaction decisions. API usage is subject to rate limits based on your plan.
We collect and process personal data in accordance with our Privacy Policy and applicable data protection laws including GDPR. For fraud detection services, you act as the data controller and we act as a data processor. We implement appropriate security measures including encryption, access controls, and monitoring to protect your data.
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for service interruptions beyond our reasonable control.
You represent that your use of domain names does not infringe on the intellectual property rights of others. We may suspend domains subject to valid intellectual property disputes. The Habilis Domains platform and technology are protected by intellectual property laws.
Our liability is limited to the amount paid for services in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. This limitation applies to the fullest extent permitted by law.
You agree to indemnify and hold harmless Habilis Domains from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of third-party rights.
You may cancel your subscription at any time from your account dashboard. We may immediately terminate accounts that violate these terms or engage in fraudulent activity. Upon termination, you remain responsible for all accrued charges. Your data will be retained for 30 days after termination, then permanently deleted.
Disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in San Francisco, California, and governed by California law.
We may modify these terms at any time with 30 days notice. Continued use of services after changes constitutes acceptance of new terms. Material changes will be prominently announced on our website.
